If your claim is denied at the initial stage, there are up to four levels of appeal available:

  1. Reconsideration: Your claim is reviewed anew by someone who was not involved in the initial decision. Both the original evidence and any new information you submit are considered.
  2. Hearing by an Administrative Law Judge (ALJ): In the Philadelphia area and South Jersey, hearings usually occur in the Social Security Administration offices in Center City Philadelphia, Elkins Park, and Pennsauken, NJ. Most cases we handle are approved at this level.
  3. Review by the Appeals Council: If the ALJ denies your case, the Appeals Council of SSA can review the decision. They may also send your case back to an ALJ for another hearing.
  4. Federal Court Review: If the decision by the Appeals Council is still unsatisfactory, you have the right to file a lawsuit in the Federal District Court. Representation by an attorney admitted to practice before the U.S. District Court in Pennsylvania or New Jersey is required at this level. Silver & Silver handles many such claims in District Court and will always review your claim for possible District Court appeal if warranted. 

Remember, once your benefits are denied, time is of the essence. It’s crucial not to miss the appeal deadline!
